Topic: Was the 12/29 PACT Board Meeting legal?
According to the Open Meetings Act, sufficient notice must be given for a meeting. Further, "changing the method is allowed, but only after the body
approves the change in an open meeting and announces the
new method at an open meeting."
According to the official Notes from the Meeting, "a called meeting of the PACT Board was posted on the Secretary of State website, Treasury
website, and PACT website on December 21st".
I have to assume that the meeting was truly posted as described, but question if this is in accordance with established prior practice? If not, then the requirement was not met and the law was broken - possibly rendering anything that occured at the meeting meaningless if a complaint is filed with the courts within 21 days of the meeting. (see pp 32-33 of Open Meetings Act) What was the prior practice? Were other methods of communications used that were abandoned specifically for this meeting to be held in a less publicized fashion? If anyone is aware of any method of notification for prior meetings not used this time, please post them. Then, someone needs to file an official complaint by January 19 to attempt to void the actions of the Board at the meeting.
