Just received the following from Dr. Richard Huckaby:


Patti and I are in the Senate Gallery now.

We have met with Lt. Gov Folsom, Chip Hill (his aid) and Senator Bedford.

The Senate subcommittee has kept HB747 alive and has gained its third reading to reach the Senate floor now. The Holmes amendment was REMOVED (that was the amend to not guarantee all contracts) by a Senate amendment, should now go to the Senate floor (we are waiting), then would have to go back to House….I honestly don’t think this will pass cause it is a constitutional amendment that has to be popular voted on.


There are several resolutions passing around to firm up language similar to our resolution….these are yet to be read on the Senate floor.



Kay Ivey was in our committee meeting with Bedford today…she was very upset…I will leave it at that for the moment.


We have gotten assurances from every legislator that PACT will not be dissolved.


There is also a push to have Gov. Riley call a special session for PACT also…

We have been interviewed by two TV stations so far. More to come

Can  we not try to get them to pass something that does NOT require a constitutional amendment!
The voters will kill it and then the legislature will say "we tired"

Waiting on a resolution that may satisfy requirements...

HB747 that passed Senate committee today amended and most likely will not be read today on the Senate floor

My apologies for my earlier remark that this was good news.  It's called "running off at the mouth before you think".  I was just so relieved that the contracts would survive for a little longer that I went off "half-cocked".  I now realize after thinking about it and having other people point out problems, that I, too, don't feel a constitutional amendment would make it.  Keeping fingers crossed for something we can count on. If not,  I hope the governor will call a special session to address the PACT problem.

I'm sorry but from all the comments I've read that have been posted with internet articles about PACT I do not believe a constitutional amendment would pass and it's not the answer.

Corresponded w/Gerry Sasnette in Lt. Gov. Folsom's office this p.m. - last response I rec'd was that the Bill worked on by the Senate committee was not likely to move and that Dr. Bronner was being considered to work up some sort of actuarial report - don't know if it's hit the web yet or not - everyone needs to pray about the special session.

I just got home. After dinner I will post the opinions Patti and I have concluded from today.

For the moment all should email and call your REPRESENTATIVE's phone and tell them to pass SJR150...it has to pass the rules committee of the House in the morning before it can be presented on the House floor...I will post there Rules members also later this evening.

Our reccomendation is not to ask for any support from the Senate on HR747, even though it passed 2nd read in Senate committee today...its too chancy that it would never pass a public vote and if it doesn't in 2010 then we are back to the drawing board....

Notes from trip to Alabama State House

•    Our initial visits with Senator Bedford and committee, Lt. Gov. Folsom and staff were productive in getting our two top points across: Short term goal is to assure PACT holders that Summer/Fall 2009, Spring 2010 and Summer 2010 tuitions will be paid as customary while long term solutions have time to be explored and implemented by the legislature early in the next session
•    Bedford’s committee passed the second reading of HR747 removing the House (Holmes) amendment that only guaranteed contracts up to 1995…this was removed and passed. This bill is not expected to pass either the Senate or House by tomorrow and that is our wish. It requires a popular vote Constitutional amendment.
•    Senator Roger Bedford is a very strong supporter of PACT…he reviewed his resolution with us prior to submission to the Senate body today.
•    We spoke with Treasurer Kay Ivey at length today regarding many facets of Alabama politics and the future of the PACT program. We expressed concerns to her about overall perception of the public about where they think she is leading the PACT program. She has assured us that:

1.    She is committed to save the PACT program if she can get support from the Alabama Legislature
2.    She will redirect the Official Alabama PACT website back to its original version. The current website automatically goes to Contract Options rather than their original home page, with the perception by many on our site that she is recommending bailing out of the PACT program.
3.    She will reiterate at the Board of Directors meeting next Wednesday that she is in full support of saving the PACT program not eliminating it…another misconception she believes.
4.    She has assured us that all PACT contract holders will be notified soon in writing as to position the PACT board is taking for the near future...

•    Senator Roger Bedford called on all Senators to cosponsor the SJR150 posted on our site now… every senator cosponsored the resolution to show support for the PACT holders. It was passed unanimously by the Senate with minimum discussion other than support.
•    We understand that SJR150 is in the Rules committee of the House for hopefully a favorable vote to send it to the House floor for immediate voice tomorrow. We will be watching closely.

We want to thank the Senators Bedford, Holley, Orr and Benefield and their staff for their time, hospitality and use of their offices today.

We want to thank Lt. Gov. Folsom, Chip Hill and Gerry Sasnette (Folsom Staff) for their generous hospitality today.

We also want to thank the news media at large for their positive support of SaveAlabamaPACT.com!

In conclusion, we hope we took the message to Montgomery that you as the body of supporters of SaveAlabamaPACT and contract holders wanted. We feel we accomplished a lot today…we will see in weeks to come how things continue to progress.

Patti and my thoughts are that we are in this for the long haul and we did not want our constituents to just jump on the first life raft that came along. We need a solid plan…this plan will take at least some time…for now we believe the PACT payments to contract holders will be available as attested by many today…

But be sure, our fight is not over; we still have miles to go…increasing tuitions, politics, and budget shortfalls, continuing lawsuits…say tuned and stay close…we will see what tomorrow brings…for tonight…good night

I just got off the phone with Rep. Jim McClendon.  He is supportive of the PACT.  Great guy! He felt the key to insure that each PACT contract would be upheld was Bonner's financial analysis.  Any decisions should wait until Bonner's report was completed.

I t is my belief that I just heard a few minutes ago SJR150 PASS unopposed and without discussion via the House Audio feed...I am trying to confirm
