8 CALLING ON RETIREMENT SYSTEMS OF ALABAMA TO CONDUCT
9 AN ACTUARIAL STUDY OF THE PACT PROGRAM AND MAKE
10 RECOMMENDATIONS TO THE GOVERNOR AND INDIVIDUAL MEMBERS OF THE
11 LEGISLATURE.

13 WHEREAS, the Alabama Prepaid Affordable College
14 Tuition (PACT) Program was created to assist individuals in
15 paying the costs and expenses of and to encourage more
16 students to attend institutions of higher education; and
17 WHEREAS, throughout the many years of successful
18 operation of the PACT Program, the public has invested in the
19 program to provide a college education and hopefully a
20 brighter future for their children, grandchildren and loved
21 ones; and
22 WHEREAS, the funds invested in the PACT Program have
23 been impacted by the recent economic crisis and concerns about
24 the solvency of the program, the ability of the PACT Board to
25 honor PACT contracts, and increasing tuition costs, have
26 intensified; and

1 WHEREAS, the approximately 48,000 program
2 participants who are currently enrolled in college or
3 preparing to attend college should receive the benefits that
4 are specified and implied in the contracts written and issued
5 by the PACT Board; and
6 WHEREAS, the PACT Program contracts maturing within
7 the next three to four years are reported to be secure;
8 however, there should be a thorough review of the financial
9 issues facing the PACT Program and to note any evidence of the
10 failure of the proper administration of the program, including
11 the short-term and long-term finances of the program; and
12 WHEREAS, although neither the Governor nor the
13 Legislature administered the PACT Program, both are determined
14 to preserve the fund that allows many in this state to attend
15 college; now therefore,
16 BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH
17 HOUSES THEREOF CONCURRING AND WITH THE GOVERNOR'S SIGNATURE
18 HEREIN AFFIXED, That we call on the Retirement Systems of
19 Alabama to conduct a thorough actuarial study of the financial
20 issues of the PACT Program. We hereby request its findings and
21 recommendations to be provided to the Governor and to each
22 member of the Legislature. We urge that this study begin
23 immediately following the enactment of this resolution at a
24 time, date, and place as directed by the Chief Executive
25 Officer of the Retirement Systems, who shall serve as the
26 director of the study. The Retirement Systems shall not be
27 limited in scope or access to information issues affecting the

1 PACT Plan including, but not limited to, any existing
2 legislative proposals for addressing its findings. The State
3 Treasurer is requested to provide to the Retirement Systems of
4 Alabama all the assistance, both technical and clerical,
5 needed for this actuarial study. The Legislature and the
6 Governor, with a sense of urgency, calls upon the Retirement
7 Systems of Alabama to report its findings, conclusions, and
8 recommendations in writing to the Governor and individual
9 members of the Legislature as soon as possible. Any incurred
10 costs shall be paid out of any funds appropriated to the use
11 of the Legislature by means of warrants drawn by the state
12 Comptroller on the State Treasury.

My son is in Auburn TODAY from Marshall County, in anticipation of attending tomorrow's AU Transfer Student Orientation (he's transferring from Snead State Community College).  Likewise, I'm signed up to attend an AU Parent Orientation. At 2:00 P.M. tomorrow, he meets with a college academic advisor and registers for his fall classes, at which time I've instructed him to inform the AU reps, if applicable at that time, that he is the benefactor of a PACT contract (purchased in 1993)."

What weight does a resolution carry?

What is the next step for a resolution. ...Does it have to go to the house?
Does this mean they've dropped the idea of working out the House bill?

I just got home. After dinner I will post the opinions Patti and I have concluded from today.

Mary, I think your summary is accurate...

For the moment all should email and call your REPRESENTATIVE's phone and tell them to pass SJR150...it has to pass the rules committee of the House in the morning before it can be presented on the House floor...I will post there Rules members also later this evening.

Our reccomendation is not to ask for any support from the Senate on HR747, even though it passed 2nd read in Senate committee today...its too chancy that it would never pass a public vote and if it doesn't in 2010 then we are back to the drawing board....

Today's legislative action seems to be a way to stall for time.  The message I get is that PACT will continue to pay for the coming year (since they know the funding is there) and then the public will vote in June 2010 on a constitutional amendment concerning whether or not state funds will "bail out" the PACT program.  From listening to folks where I work, the "bail out" idea would be EXTREMELY unpopular - people are angry!  I think the public will reject the amendment and we will be back where we are now - not knowing what will happen and how to plan.  In the meantime PACT still holds and manages the money we used to purchase the contracts (not earning interest) and we have little time to save (my twins start in the fall of 2010).   Of course, the 'let the people decide' approach would buy some time for the stock market to recover some (if it is going to - no guarantees on that), in which case many people might not feel as financially stressed as they do now.  It also means the the lawsuits pending would be stalled....

3xPACT,

Not sure but you may have misunderstood at least what we understood today in  Montgomery. SJR150 that passed is not depending on HR747 which requires a near impossible constitutional amendment to pass a popular vote next year...

It essentially is to replace the HR747 although amended in the Senate today. Chances of it coming to a vote and passing tomorrow and then goiing back to the House are like "slim and none".

I believe it is the majorities opinion on our site that we would much prefer this bill to just die...

SJR150, assuming passes House tomorrow, should head us in the right direction along with the many public statements by legislators coming...Folsom's is already posted.

Thanks.  So SJR150 would ensure that ALL PACT purchasers (pre and post 1995) would see their contracts honored?

In essense, since it does not address that there is any difference between the two...all continue to be honored just as has been in the past...

I do want to state in the light of day that the Resolution SJR150 that we [all] believe is the right thing and best option at this juncture, being where we are is where we are, is just that...a resolution. As stated before it indicates the "will of the body". Now if you are a lawyer you say...BS, worth nothing...if you are a political scientist or politician, you say does every name on that Resolution want to lose 49,000 votes x everyone we organize and tell to vote against them next year, if they do not come through with legislation to back up the resolution next year?...Answer is NO, given the public outcry, the media coverage so positive on PACT, our oversight, and the legislature/Gov/Lt. Gov public statements...I think I can live with that and give them a chance to review and adopt the correct answer.

Remember also we live on...our job of oversight is hardly beginning...this was just the first step to ease the pain of so many waiting and watching...

Please watch the news, our site, etc today, I do not want to speak prematurely. This resolution SJR150 must pass the House TODAY! Without that or a Special Session called by the Gov we are back at the beginning...


I URGE ALL TO CALL THEIR REPRESENTATIVE THIS MORNING AND ASK THEM TO VOTE YEA FOR SJR150 (We want a unamimous vote in the HOUSE also today)

I called my Rep Laird, got him in the committe meeting...a miracle

I just heard from Rules Committee Laird....IT IS ONE THE CALENDAR TODAY...

I told him hit a home run...make it unaminous in the House today

I am so greatful for all the hard work in Montgomery by Dr. Huckaby and Patti Lambert.  I believe the HJR150 is a step in the right direction. 

I am a little confused as to where exactly we stand now.  My first PACT grandchild doesn't begin college until fall,2010, and so the personal impact to me isn't as dire as for some others who have children wanting to enroll in fall of 2009.  Do we know yet if this will be possible?  Is this to be decided on May 20 Board Meeting or will it take something more (senate/house)?    It seems Ivey and her "bunch" could make this decision next Wednesday, couldn't they?  If this is the case, we probably need to have as many people turn out for that meeting as possible.

Ivey has given assurances to us yesterday that she has no intent to dissolve (she also is only 1 vote of 10 on BOD) as long as there are options...we believe SJR150 passing has given her an option to stay the course...


We will need all of you in Montgomery that can come though. Oversight is very important...we are planning on meeting before and after the BOD meeting...time and place TBD by this weekend.
