Obviously Alvin Holmes does not want this bill to pass; he knows full well that the bill as amended is not acceptable to most PACT contract holders, and therefore has no chance of passing.
Mr. Holmes considers any $ used to rescue PACT as welfare for wealthy white folks and truthfully does not support PACT for that reason. The only reason he put in language to honor the pre-1995 contracts is because he knows that legally the State is on the hook for those contracts. If not for that he would do everything in his power to kill any PACT rescue.
I (probably like most other PACT holders) am not wealthy and absolutely struggled to pay for a PACT for my child (I bought in 1994 before the "guarantee" was removed). My child is currently a high school freshman, so I have a little time to see what type of solution the legislature can pass.
I have been patient so far with this whole mess; however, if nothing is done soon, I will not hesitate to file a lawsuit against the State, the PACT board, and PACT board members personally, for not only my child's tuition, but also legal fees and any and all punitive damages possible.
If the State does not honor my contract AS WRITTEN, they have in my opinion committed a fraud and I intend to seek any and all legal remedies at my disposal.
